2. Nature of the Platform

2.1 Lustia operates solely as an online advertising directory. We do not provide, arrange, or supervise any services advertised on the platform.

2.2 Specifically, Lustia:

• Does not act as an agency
• Does not arrange bookings or appointments between Users and Advertisers
• Does not process payments for any services advertised by Advertisers
• Does not supervise, monitor, or moderate communications or interactions between Users and Advertisers, except where required by law or by these Terms
• Does not verify the accuracy, legitimacy, qualifications, or conduct of any Advertiser
• Does not endorse any Advertiser, even where verification badges or featured placements are used

2.3 All communications, bookings, and transactions for advertised services occur directly between Users and Advertisers. Lustia is not a party to those interactions.

3. Directory Services — Terms for Advertisers

3.1 General Terms for Advertisers

3.1.1 Lustia.com.au provides digital and online services to advertise Australian erotic massage therapists, establishments, and agencies, and to allow users to search for erotic massage services.

3.1.2 By submitting an advertisement on Lustia.com.au, you agree that:

• You are over 18 years of age and will not misrepresent your age.
• You are independent and not affiliated with any competitor directory or platform.
• You own or have written permission to use any materials submitted for publication, including photographs and text.

3.2 Verification

3.2.1 Advertisers must complete photo verification when requested by Lustia. Failure to pass verification may result in suspension of the advertisement.

3.2.2 Lustia may at any time request identification documents to confirm that an Advertiser is over 18 years of age and that the listing is authentic.

3.2.3 Verification status does not constitute endorsement by Lustia.

3.3 Account Responsibility

3.3.1 Advertisers are responsible for:

• The accuracy and currency of their listing
• Maintaining the security of their login credentials
• All activity that occurs under their account

3.3.2 Advertisers must notify Lustia immediately if they suspect unauthorised access to their account.

3.3.3 Advertisers may delete an advertisement or close their account at any time from within their account settings. Deletion does not entitle the Advertiser to a refund of any unused advertising period (see clause 3.10).

3.4 Prohibited Conduct

3.4.1 Your advertisement or account may be removed or suspended without refund if:

• You use another person's photographs or advertising materials
• You operate as a competitor directory or redirect users to another directory or platform
• You mislead or misrepresent your identity, services, or affiliation
• You upload imagery that breaches our content standards (see Section 4)
• You promote services that are prohibited (see Section 5)
• You breach these Terms and Conditions

3.5 External Links

3.5.1 Advertisers may include a link to their personal website or social media on their profile.

3.5.2 It is strictly prohibited to:

• Add links directing to another advertising platform or directory
• Promote listings hosted on competing directories
• Redirect users to external websites offering the same type of advertising services as Lustia

3.5.3 Any violation may result in removal of the link, suspension of the advertisement, or termination of the account.

3.6 Right to Display

3.6.1 Advertisers retain ownership of their submitted content.

3.6.2 By submitting materials to Lustia.com.au, you grant Lustia a non-exclusive, royalty-free licence to:

• Display, host, and reproduce the materials on the platform
• Modify formatting for layout and readability
• Optimise descriptions for search engine performance (SEO)
• Promote the materials within the platform

3.7 Promotional Use & Free Bumps

3.7.1 By submitting a listing, the Advertiser agrees that Lustia may use their profile content (including images and descriptions) for promotional and marketing purposes related to Lustia.

3.7.2 This may include publication on:

• Lustia's social media platforms
• Lustia's advertising campaigns (online and offline)
• Marketing materials and email campaigns related to Lustia

3.7.3 Lustia will not alter the fundamental meaning of the services offered and will represent the Advertiser fairly and accurately.

3.7.4 As part of Lustia's ongoing promotional activity and to thank Advertisers for being part of the platform, Lustia may at its discretion bump an Advertiser's listing for free, give complimentary featured placements, or apply other promotional credits to the Advertiser's account. These are gifts and do not create any entitlement, ongoing obligation, or right to compensation. Lustia may add, change, or stop these promotions at any time without notice.

3.7.5 Advertisers may opt out of external promotional use at any time by contacting Lustia.

3.8 Advertisement Review and Editing

3.8.1 All advertisements submitted by Advertisers may undergo review by Lustia before publication.

3.8.2 Lustia reserves the right to reject, edit, or request modifications to listings that do not meet platform standards.

3.8.3 Lustia may make minor edits to profile descriptions for formatting, readability, and search engine optimisation. These changes are intended to improve visibility while preserving the original meaning of the services offered.

3.8.4 If an Advertiser believes any modification does not accurately reflect their services, they may contact Lustia to request a review or revert the change.

3.9 Legal Compliance

3.9.1 As an Advertiser, you are solely responsible for ensuring your advertisements comply with all relevant Australian laws, including but not limited to:

• Competition and Consumer Act 2010 (Cth)
• Fair Trading Acts in applicable states and territories
• Privacy Act 1988 (Cth) and the Australian Privacy Principles
• Online Safety Act 2021 (Cth) and applicable industry codes
• Anti-discrimination and equal opportunity laws
• State and territory laws relating to sex work and adult services advertising

3.10 Advertising Period

3.10.1 Advertising periods begin on the agreed date.

3.10.2 Once advertising has been purchased, the advertising period cannot be paused. Advertisers may choose to hide their advertisement from public view at any time, but the advertising period will continue to run down in the background.

3.10.3 No refunds or extensions are issued for time during which an advertisement was hidden by the Advertiser, or for time remaining if the Advertiser chooses to delete their advertisement or account before the period ends.

4. Content Standards & Online Safety Compliance

4.1 Background

4.1.1 The Australian eSafety Commissioner has registered industry codes under the Online Safety Act 2021 (Cth) which apply to platforms hosting adult content. From 9 March 2026, sites with adult content must take reasonable steps to limit minors' exposure to that content.

4.1.2 To remain compliant, Lustia has updated its content standards. By submitting an advertisement you agree to comply with the standards in this Section 4.

4.2 Prohibited Imagery

4.2.1 The following are not permitted in any photograph displayed publicly on Lustia:

• Visible genitals
• Exposed nipples
• Sexual activity

4.2.2 Lustia provides a built-in blur tool in the photo editor. Advertisers are responsible for using this tool to obscure any prohibited content before saving.

4.2.3 Lustia may, at its discretion and without prior notice, remove any photograph that does not meet these standards. Repeated breaches may result in account suspension.

4.3 Lawful Service Descriptions

4.3.1 Sex work is decriminalised in NSW, Victoria, Queensland, the Northern Territory, and the ACT. Advertisers operating in these jurisdictions may describe their lawful services in text within their listing.

4.3.2 Advertisers in jurisdictions where sex work is regulated or restricted (including South Australia, Western Australia, and Tasmania) must ensure their advertisement complies with applicable state law.

4.4 Image Authenticity

4.4.1 All photographs must be of the Advertiser themselves. Stock images, AI-generated imagery, third-party photographs, and photographs of other people are not permitted.

4.4.2 Lustia may request photo verification at any time. Failure to verify may result in advertisement removal.

4.5 Reporting and Removal

4.5.1 Users may report content that breaches these standards through the in-platform reporting tools.

4.5.2 Lustia will review reports and remove non-compliant content within a reasonable timeframe.

5. Prohibited Services

5.1 Advertisers must not promote, offer, or facilitate any services that are illegal under Australian law.

5.2 Without limiting the generality of clause 5.1, the following are strictly prohibited and will result in immediate removal of the advertisement and account, and may be reported to law enforcement:

• Services involving any individual under the age of 18
• Human trafficking or exploitation in any form
• Coercion, deception, or forced services
• Illegal prostitution or unlicensed adult services in jurisdictions where licensing is required
• Services advertised by, or on behalf of, a third party without that party's consent
• Any activity that violates applicable Commonwealth, state, or territory laws or regulations

5.3 Lustia reserves the right to remove any listing suspected of promoting prohibited or unlawful services, with or without prior notice, and to cooperate fully with any law-enforcement investigation.

6. Terms for Users

6.1 Adult Content and Age Requirement

6.1.1 Lustia.com.au contains adult-oriented listings intended for individuals aged 18 years or older.

6.1.2 By accessing this website you confirm that:

• You are at least 18 years of age
• Accessing adult-oriented material is legal in your jurisdiction
• You are accessing the site of your own free will

6.2 General Terms for Users

6.2.1 Users search and use the Website at their own risk.

6.2.4 Users may delete their account at any time from within their account settings.

7. User Conduct

7.1 All Users of the platform — including those browsing without an account — must use the website responsibly and lawfully.

7.2 Users must not:

• Harass, threaten, intimidate, or stalk Advertisers or other Users
• Attempt to engage Advertisers in any illegal activity
• Misuse contact information published on the platform (see Section 8)
• Post abusive, defamatory, hateful, or unlawful communications via in-platform messaging or reviews
• Attempt to impersonate another person, including any Advertiser
• Reproduce or distribute Website materials without prior written consent from Lustia
• Attempt to circumvent any security or verification measure on the platform

7.3 Lustia reserves the right to block, suspend, or permanently ban any User who breaches this Section 7, without notice and without refund of any unused account balance or featured placement.

7.4 Conduct that may also constitute a criminal offence (including stalking, harassment, or threats of violence) may be reported to police.

8. Unauthorised Use of Provider Information

8.1 All contact information, profiles, images, and content published on Lustia.com.au are provided exclusively for the purpose of allowing Users to connect directly with Advertisers in accordance with these Terms.

8.2 You must not:

• Use, copy, scrape, or extract any data or contact details from Lustia.com.au for marketing, solicitation, or recruitment purposes
• Contact any Advertiser listed on Lustia.com.au for commercial solicitation, including promoting or recruiting for competing platforms, directories, or agencies
• Share, sell, or distribute any Advertiser's personal or contact information without prior written consent
• Use any automated tool (bot, scraper, crawler) to access or extract content from the platform

8.3 Any unauthorised use of provider information, including contacting Advertisers without consent for solicitation, business promotion, or recruitment, is strictly prohibited.

8.4 Such conduct may result in:

• Permanent account suspension
• Legal action for breach of these Terms and potential breach of the Privacy Act 1988 (Cth) and the Spam Act 2003 (Cth)
• Reporting to relevant authorities for misuse of personal information

9. Payments & Membership

9.1 General

9.1.1 Advertising fees are non-refundable except where required by Australian Consumer Law.

9.1.2 Advertising begins once payment has cleared.

9.1.3 Trial periods, free placements, free bumps, and promotional offers are at Lustia's discretion and may be modified or withdrawn at any time.

9.2 Suspension for Non-Payment

9.2.1 Listings may be suspended or removed if a recurring payment fails or is not received by the due date.

9.2.2 Lustia is not liable for any loss of visibility or revenue resulting from a suspension caused by payment failure.

9.3 Refunds

9.3.1 Refunds are provided only at the absolute discretion of Lustia and in accordance with Australian Consumer Law.

9.3.2 Refunds will not be issued for change of mind once advertising space has been purchased and activated, or for advertising time remaining if the Advertiser deletes their advertisement or closes their account.

10. General Terms

10.1 Suspension and Termination

10.1.1 Lustia reserves the right to remove, suspend, or terminate any listing or account that:

• Violates these Terms
• Misrepresents identity or services
• Breaches applicable laws
• Harms platform integrity or other Users / Advertisers

10.1.2 Advertisers and Users may also delete their advertisement or close their account at any time from within their account settings, subject to clauses 3.10.3 and 9.3.2.

10.2 Liability and Indemnity

10.2.1 To the maximum extent permitted by law:

• Lustia is not liable for any direct, indirect, incidental, or consequential losses arising from use of the Website or Services
• Lustia's total liability to any Advertiser is limited to the amount paid by that Advertiser in the most recent subscription or advertising period, or the cost of re-supplying the Services, whichever is lower

10.2.2 Users and Advertisers indemnify Lustia.com.au, its owners, officers, and agents against all claims, liabilities, damages, costs, and expenses (including legal costs) arising from:

• Breaches of these Terms
• Misuse of the Website or Services
• Content submitted by the Advertiser
• Conduct of the Advertiser or User outside the platform

10.3 Changes to These Terms

10.3.1 Lustia may update these Terms from time to time. Material changes will be communicated by email to active Advertisers and noted on this page.

10.3.2 Continued use of the Website after changes take effect constitutes acceptance of the updated Terms.

10.4 Governing Law

10.4.1 These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.

10.5 Severability

10.5.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
