TERMS AND CONDITIONS – ADVERTISING SERVICES

If you, as the Advertiser or User, do not agree to be bound by these Terms and Conditions, you must not use this Website, and you must exit the Website immediately. You may not access, print, or download any materials from this site unless you agree to these Terms.

1. WHO WE ARE

1.1 Lustia.com.au (“Lustia”, “we”, “our”, “us”) provides an online platform for the publication and display of advertisements for female erotic massage therapists, establishments, and agencies in Australia (the “Services”).

1.2 These Terms and Conditions outline the rights and responsibilities of each party in using the Services provided by Lustia.com.au.

1.3 By using Lustia.com.au, you agree to abide by these Terms and Conditions as they may be updated from time to time.

2. DIRECTORY SERVICES – TERMS FOR ADVERTISERS

2.1 General Terms for Advertisers

2.1.1 Lustia.com.au provides digital and online services to:

• Advertise Australian female erotic massage therapists, establishments, and agencies (“Advertisers”); and

• Allow users to search for erotic massage services (“Users”).

2.1.2 By submitting an advertisement on Lustia.com.au, you agree that:

• You are over 18 years of age and will not misrepresent your age.

• You are independent and not affiliated with any competitor directory or platform.

• You own or have written permission to use any materials submitted for publication (e.g., photographs, text).

• You acknowledge that Lustia.com.au strictly accepts advertisements for female providers only. Advertisements for male providers are not permitted under any circumstances.

2.2 Prohibited Conduct

2.2.1 Your advertisement or account may be removed without refund if:

• You use another person’s photographs or advertising materials.

• You operate as a competitor directory or redirect users to another directory or platform.

• You mislead or misrepresent your identity, services, or affiliation.

• You attempt to list an advertisement for a male provider.

• You breach these Terms and Conditions.

2.3 Right to Display

2.3.1 By submitting materials to Lustia.com.au, you grant Lustia a non-exclusive, royalty-free licence to host, display, and use the materials solely on our platform and associated services for the purpose of providing and promoting your advertisements.

2.3.2 This licence does not extend to the use of your materials outside Lustia.com.au without your explicit consent. You retain full ownership of your materials.

2.4 Legal Compliance

2.4.1 As an Advertiser, you are solely responsible for ensuring your advertisements comply with all relevant Australian laws, including but not limited to:

• Competition and Consumer Act 2010 (Cth);

• Fair Trading Acts in applicable states and territories;

• Privacy Act 1988 (Cth) and the Australian Privacy Principles;

• Anti-discrimination and equal opportunity laws.

2.5 Advertising Period and Pause Requests

2.5.1 Advertising periods begin on the agreed date.

2.5.2 Advertisers may request to pause their advertisements, and any prepaid advertising credits must be used within 90 days.

2.5.3 Unused credits will expire after this period.

2.6 Refunds

2.6.1 Refunds are only provided at the absolute discretion of Lustia.com.au and in accordance with Australian Consumer Law.

2.6.2 Refunds will not be issued for change of mind once advertising space has been purchased and activated.

3. TERMS FOR USERS

3.1 General Terms for Users

3.1.1 Users search and use the Website at their own risk.

3.1.2 Lustia.com.au is a directory platform and does not verify the accuracy, legitimacy, or qualifications of Advertisers.

3.1.3 Lustia.com.au disclaims all liability for:

• Errors, omissions, or inaccuracies in advertisements;

• Transactions or communications initiated due to advertisements on the Website.

3.2 Obligations of Users

3.2.1 Users agree to:

• Use the Website in compliance with applicable laws;

• Exercise caution when engaging with Advertisers;

• Not reproduce or distribute Website materials without prior written consent from Lustia.

4. UNAUTHORISED USE OF PROVIDER INFORMATION

4.1 All contact information, profiles, images, and content published on Lustia.com.au are provided exclusively for the purpose of allowing Users to connect directly with Advertisers in accordance with these Terms.

4.2 You must not:

• Use, copy, scrape, or extract any data or contact details from Lustia.com.au for marketing, solicitation, or recruitment purposes;

• Contact any Advertiser listed on Lustia.com.au for commercial solicitation, including but not limited to promoting or recruiting for competing platforms, directories, or agencies;

• Share, sell, or distribute any Advertiser’s personal or contact information without their prior written consent.

4.3 Any unauthorised use of provider information — including contacting Advertisers without consent for solicitation, business promotion, or recruitment — is strictly prohibited.

4.4 Such conduct may result in:

• Permanent account suspension;

• Legal action for breach of these Terms and potential breach of the Privacy Act 1988 (Cth); and/or

• Reporting to relevant authorities for misuse of personal information.

5. GENERAL TERMS FOR ADVERTISERS AND USERS

5.1 Liability and Indemnity

5.1.1 To the extent permitted by law, Lustia.com.au:

• Is not liable for losses arising from the use of the Website or Services; and

• Limits liability to the re-supply of the Services or the cost of re-supply.

5.1.2 Users and Advertisers indemnify Lustia.com.au, its owners, and agents against all claims, liabilities, damages, costs, and expenses arising from:

• Breaches of these Terms; or

• Misuse of the Website or Services.
